Representing Grandparent’s Rights in San Francisco

When a marriage or relationship ends in divorce or separation, grandparents are usually the ones to suffer, especially if their relationship with either party is contentious as a result.  But just because a relationship or marriage has ended, does not mean that the relationship between a grandparent and grandchild also has to end.  For grandparents who wish to maintain a relationship with their grandchildren after a divorce, separation, or even a relocation, there are options.  If you are a grandparent wishing to preserve your relationship with your grandchildren, a San Francisco grandparent rights attorney at our firm can help you take legal action to get custody or visitation rights.

Grandparental Rights in California & San Francisco

Visitation

Unfortunately in California, when it comes to visitation rights, grandparents do not have an absolute right.  However, judges have been known to grant visitation rights against the parents’ wishes if they feel it’s in the best interest of the child.  A judge is also likely to grant visitation rights to the grandparents if there is already a pre-existing relationship between the grandparents and the child.

There are a number of circumstances in which a judge may grant visitation rights to the grandparents, such as:

  • One or both of the child’s parents have died
  • One parent is awarded sole physical custody of the child
  • The child’s parents are divorce or separated
  • The child isn’t in the custody of either parent.

Custody

In some situations, grandparents can file for custody of their grandchild. However, this can be difficult because the law always favors the parents first and foremost. However, there are some circumstances in which the court may grant child custody to the grandparents, such as when:

  • The parents are unable to care for their child due to drug or alcohol abuse, a history of abuse or neglect, mental incapacitation, or an inability to financially care for the child
  • Both parents have died
  • The parents to choose to give up custody of the child
